Chapter 13 bankruptcy is commonly known as wage earners bankruptcy. When you file, an automatic stay will stop foreclosure on your house and repossession of your car. It allows you to create a payment plan so you can pay back your overdue payments in either three or five years and you get to stay in your house and keep your car. During that time, you have to keep up with current payments as well.

Once you have finished your payment plan, any additional unsecured debts, like credit card debt or medical bills, will be discharged. You will be all caught up on your arrearages and able to start fresh.
